Terms of Service

1. Acceptance of Terms

By accessing or using IdeaFlare ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. IdeaFlare is developed and published by ZKidz Dev ("we," "us," or "our").

2. Description of Service

IdeaFlare is an AI-powered ideation platform that allows users to capture ideas via text or voice, submit them for AI analysis, and receive structured outputs including summaries, feature lists, execution plans, tasks, and risk assessments. The App also provides task management, organization tools, and third-party integrations.

3. Account Registration

To use IdeaFlare, you must create an account using a valid email address or through a supported social authentication provider (Google, Apple). You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must be at least 13 years old to create an account. By creating an account, you represent that you meet this age requirement.

4. Subscription and Billing

IdeaFlare offers three subscription tiers:

  • Free: Limited to 1 idea per month and 60-second voice recording. No integrations.
  • Pro ($7.99/month or $59.99/year): 100 ideas per month, 5-minute voice recording, 5 integrations, and advanced AI features.
  • Premium ($14.99/month or $119.99/year): 1,000 ideas per month, 15-minute voice recording, unlimited integrations, and all features.

Subscriptions are billed through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis. Subscriptions auto-renew unless cancelled before the end of the current billing period.

You may cancel your subscription at any time through the App settings or the Stripe customer portal. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods.

5. Content Ownership

Your content: You retain all rights to the ideas, text, and voice recordings you submit to IdeaFlare. By using the service, you grant us a limited license to process your content through our AI systems solely for the purpose of providing the service.

AI-generated outputs: The structured outputs generated by AI (summaries, features, tasks, execution plans, risk assessments) are provided to you for your use. We do not claim ownership of AI-generated outputs based on your input.

6. AI-Generated Content Disclaimer

IdeaFlare uses third-party AI models (including Google Gemini) to generate content. AI-generated outputs are provided "as is" and may contain inaccuracies, errors, or unsuitable suggestions. You should:

  • Review all AI-generated content before acting on it
  • Not rely solely on AI outputs for business, legal, financial, or medical decisions
  • Understand that AI outputs do not constitute professional advice

We are not responsible for any decisions or actions you take based on AI-generated content.

7. Acceptable Use

You agree not to use IdeaFlare to:

  • Submit content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
  • Attempt to circumvent subscription limits or abuse the free tier
  • Reverse engineer, decompile, or disassemble any part of the App
  • Use automated systems or bots to access the service
  • Interfere with or disrupt the service or servers
  • Impersonate another person or entity

We reserve the right to suspend or terminate accounts that violate these terms.

8. Third-Party Integrations

IdeaFlare allows you to connect third-party services including Linear and GitHub. When you connect an integration, you authorize us to access your data on those platforms as necessary to provide the sync functionality. Your use of third-party services is governed by their respective terms of service and privacy policies.

We are not responsible for the availability, accuracy, or security of third-party services. You can disconnect integrations at any time from the App settings.

9. Termination

You may delete your account at any time from the Settings screen. Account deletion is permanent and irreversible — all your data will be removed.

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or abuse the service. We will make reasonable efforts to notify you before termination except in cases of severe violations.

10. Limitation of Liability

To the maximum extent permitted by law, ZKidz Dev shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the App.

Our total liability for any claims arising from or related to these Terms or the App shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Disclaimer of Warranties

IdeaFlare is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We do not guarantee the accuracy or reliability of AI-generated content.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App or via email. Your continued use of IdeaFlare after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.
